This lesson will ask students to engage with landmark freedom of press case studies exploring how the Supreme Court has ruled on First Amendment issues and has tried to balance competing values in our democracy.
Government Speech Under the First Amendment
This lesson teaches students, through a simulation related to government-sponsored Confederate monuments, about the government-speech doctrine under the First Amendment. In particular, this lesson aims to (1) introduce students to the issue of government speech; (2) teach the doctrine; (3) apply the doctrine in a contemporary context; and (4) critically analyze the doctrine.
Freedom of Speech
In this lesson, students analyze a photo of Robert Kennedy speaking outside the U.S. Department of Justice on June 14, 1963, and use it to discuss freedom of speech as a constitutional right in the United States, and human rights around the world.
The Fugitive Slave Law of 1850
In 1850, Southerners succeeded in getting a new federal law passed to return fugitive slaves who had escaped to the North. The U.S. government enforced this law, but some Northern states passed laws to resist it. Sometimes, free blacks and sympathetic whites joined to rescue captured fugitive slaves.
The Emoluments Clause and the President (Civil Conversation)
The emoluments clause is a provision in the U.S. Constitution. An emolument is a profit or advantage an official gains from his or her office. The framers of the Constitution feared that ambassadors in the early republic might be corrupted by gifts from foreign countries. The framers wanted public servants to be free from outside influence.
The Supremacy Clause
Tension between the states and the federal government has been a constant throughout U.S. history. This video explores the supremacy clause in Article VI of the Constitution and key moments in the power struggle, including the landmark case McCulloch v. Maryland. In McCulloch, Chief Justice John Marshall wrote that the supremacy clause unequivocally states that the “Constitution, and the Laws of the United States … shall be the supreme Law of the Land.”

First Amendment: Speech
When does the First Amendment allow the government to limit speech? Many Americans struggle with understanding the language and subsequent interpretation of the Constitution, especially when it comes to the rights encapsulated in the First Amendment. While many Americans can agree that speech should be protected, there are disagreements over when, where, and how speech should be limited or restricted. This lesson encourages students to examine their own assumptions and to deepen their understanding of current accepted interpretation of speech rights under the First Amendment, including when and where speech is protected and/or limited. It should reinforce the robustness of the First Amendment protections of speech.
Learning about the Preamble to the U.S. Constitution
This resource provides students with an English language video and associated student friendly readings (in English, Spanish, and Haitian Creole), as well as reading and video guides and self assessment tools. Using these, students will explore the meaning and importance of the Preamble.

Arguing Arkansas: Analyzing the Impact of Eisenhower’s Little Rock Speech
This lesson, developed in collaboration with the National Archives, has students explore a number of primary sources, all connected to the events at Little Rock High School. It asks students to consider how the events at Little Rock may or may not have been impacted by the words and leadership of President Dwight D. Eisenhower.
